Acting early may help prevent the matter from becoming more serious.

Common mistakes include:

1. Ignoring the notice

A tenant should read the notice carefully and seek advice where necessary. Failing to respond may lead to court proceedings.

2. Stopping rent payments without advice

A dispute with the landlord does not automatically justify withholding rent. Unpaid rent may strengthen the landlord’s claim.

3. Failing to keep proof of payment

Tenants should retain receipts, bank records, Rent Book records and messages showing when rent was paid.

4. Leaving without documenting the property

Before vacating, the tenant should take photographs and record the condition of the premises, especially where there may be a dispute over the deposit or alleged damage.

5. Damaging or removing fixtures

Damage to the premises or removal of items belonging to the landlord may result in a separate claim.

6. Assuming eviction can happen immediately

A landlord cannot usually remove a tenant personally. Where the tenant does not leave voluntarily, the landlord may need to obtain a court order.

A tenant who receives a notice from a landlord should not ignore it.
