The person making the statement is called the <strong>deponent<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By signing and affirming an affidavit, the deponent declares that the contents are true to the best of their knowledge and belief. The affidavit must be signed before a person who is legally authorised to administer oaths or affirmations, usually a court manager.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Simply put, an affidavit is <strong>written evidence<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Why Are Affidavits Used?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Affidavits are used whenever a person needs to formally record facts in a legally recognised document. They are commonly used in court proceedings, but they may also be required for administrative, commercial, or personal matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because an affidavit is made under oath or affirmation, it carries significant legal weight. Anyone making a false statement in an affidavit may face serious legal consequences.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Affidavits Used in Court<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In many court applications, the judge considers the facts through affidavits and supporting documents, rather than requiring witnesses to attend court and give evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The affidavit tells the court what happened, while the supporting documents help prove those facts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, if a person states in an affidavit that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>they signed a contract, a copy of the contract should be attached;<\/li>\n\n\n\n<li>they made a payment, proof of payment or bank records should be attached;<\/li>\n\n\n\n<li>they received a letter or email, a copy of that correspondence should be attached.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These supporting documents are usually attached to the affidavit as annexures or exhibits and are referred to throughout the affidavit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An affidavit that is supported by relevant documentary evidence is generally more persuasive than one containing statements alone. Documents help the court verify the facts and strengthen the credibility of the evidence presented.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What Should an Affidavit Contain?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A well-prepared affidavit should:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>contain only facts that the deponent personally knows;<\/li>\n\n\n\n<li>be written in the first person (using &#8220;I&#8221;);<\/li>\n\n\n\n<li>be clear, accurate and organised in chronological order where appropriate;<\/li>\n\n\n\n<li>avoid opinions, arguments or legal conclusions;<\/li>\n\n\n\n<li>identify the source of any information that is not within the deponent&#8217;s personal knowledge; and<\/li>\n\n\n\n<li>refer to and attach any relevant supporting documents whenever possible.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Standalone Affidavits<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Not every affidavit is filed in court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A <strong>standalone affidavit<\/strong> is an affidavit prepared independently for a specific purpose without forming part of ongoing court proceedings. It is often used to formally confirm facts where a sworn statement is required.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Examples include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>confirming a person&#8217;s identity;<\/li>\n\n\n\n<li>declaring the loss of a passport, identity card or other important document;<\/li>\n\n\n\n<li>confirming a change of address;<\/li>\n\n\n\n<li>declaring family relationships or marital status; or<\/li>\n\n\n\n<li>providing a sworn explanation to a government department, employer, bank or other organisation.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Unlike affidavits filed in court, standalone affidavits do not usually determine a legal dispute. Instead, they serve as formal evidence of the facts stated by the deponent and are relied upon by the person or organisation requesting them.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Importance of Truthfulness<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Before signing an affidavit, the deponent should read it carefully and ensure that every statement is true and accurate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An affidavit is a sworn statement. Knowingly making a false statement is a serious matter and may expose the deponent to criminal liability for perjury or other legal consequences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For that reason, affidavits should always be truthful, supported by available evidence, and limited to facts that the deponent honestly believes to be true.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>An affidavit is a written statement of facts made voluntarily by a person under oath or solemn affirmation.
