What Is a Mise en Demeure?

What is a mise en demeure - Etude Elaheebocus

A mise en demeure is a formal, extra-judicial notice, usually prepared by an Attorney-at-Law, by which a person or company is called upon to perform a specific obligation within a stated period.

A mise en demeure should clearly and accurately identify the relevant facts, the obligation relied upon, the amount or action required, the period allowed for compliance and the consequences of non-compliance.

A mise en demeure is usually served by an usher, thereby providing reliable evidence that the notice was duly served upon the recipient.
